
In a recent development, the Bar Council of Kerala (BCK) has secured assurance from Malappuram’s Judge-in-charge, High Court Justice N. Nagaresh, regarding the swift transfer of a Temporary Judicial First Class Magistrate (JFCM), Lenin Das. The move comes in response to allegations that Magistrate Das verbally abused and ordered the arrest of Advocate Favad Pathoor for purportedly aiding a witness during chief examination.
The Tirur District Bar Association organized a protest, demanding action against Magistrate Das. In a letter to Justice Nagaresh, the association condemned the magistrate’s actions and declared their abstention from court proceedings until a resolution is reached.
Expressing solidarity, the Kerala High Court Advocates Association (KHCAA) Executive Committee voiced concern over Magistrate Das’s conduct, emphasizing the need for qualified professionals in judicial roles. The committee highlighted previous complaints about the magistrate’s inappropriate behavior towards lawyers, both in and out of the courtroom.
The KHCAA urged the High Court to take decisive action against Magistrate Das for his alleged misconduct and suggested a reconsideration of the practice of appointing Temporary Magistrates. The association called for the appointment of qualified advocates capable of upholding the dignity expected in a courtroom.
In response, the BCK intervened, assuring the Tirur Bar Association that the matter would be pursued until the High Court makes a decision. The Judge-in-charge, Justice Nagaresh, guaranteed the prompt transfer of the alleged magistrate, emphasizing the commitment to address the issue appropriately.
